DO’s AND DON’Ts WITHIN TOWN DRAINAGE EASEMENTS

An easement has been conveyed to the Town of Cicero for drainage purposes. However, the ownership and routine maintenance of this easement area rests with the property owner. It is anticipated that this area will be maintained similar to your lawn area when weather conditions permit. The following are some of the things you should and should not do relative to a Town drainage easement:

DO’s

  1. Maintain the drainage easement as your lawn area as much as practical. During wet times of the year, or along the centerline of the watercourse, it may not always be possible to mow. However, mowing and weed-wacking should be performed as field conditions allow.
  2. Notify the Town Code Enforcement Office if you observe an adjacent property owner filling, obstructing or otherwise blocking or altering the area within the Town’s drainage easement.
  3. Anticipate stormwater within the entire easement area during significant rainfall or snow melt-off conditions, even though only a small watercourse may be visible during normal conditions or frequently occurring storms

DON’Ts

  1. Fill, obstruct, block or materially alter the Town’s drainage easement or permit an existing condition in the drainage easement to remain filled, obstructed, or to otherwise impede water flow.
  2. Construct permanent fixtures such as pools, fences or buildings within the Town’s drainage easement. Also, do not install temporary obstacles such as play stations, swing sets, etc. which may impede the flow of water within the easement.
  3. Modify the existing topography of the easement by cutting or filling in such a manner as to cause material damage or to materially impair the use or to restrict the flow of stormwater within the drainage easement.
  4. Dispose of brush, grass clippings, leaves, or other such materials within the Town’s drainage easement.
  5. If you are performing work on your property adjacent to the Town’s drainage easement which involves the stripping, clearing, or grading of any parcel of land, it is recommended you or your contractor construct a silt fence (or similar device) along the drainage easement line to mitigate sediment and other erosion materials from entering the drainage easement. This is particularly important with new construction such as pools, decks and house additions.

SUMMARY

The Town and the property owners are a team in the responsibility for the proper operation and maintenance of these easements. Occasionally, it may be necessary for the Town to perform maintenance of this drainage easement when sediment deposits or similar circumstances require due to the normal acts of nature. However, the Town will not perform maintenance such as removing grass clippings, brush, leaves, or other obstructions as noted previously herein which are caused by actions of the property owner. These types of obstructions will result in a notice to the property owner of a violation of the Town’s drainage easement which will need to be rectified by the property owner, or action may be taken by the Town and costs assigned to the violator. In addition, a property owner who violates the Town easement may be liable for damage caused to other adjoining property owners by such action.
